Privacy Policy

How we collect, use and protect your personal information, including health information, and the choices you have.

In short: your results belong to you. We collect what we need to map your brain and prepare your report, we keep it secure, and we never share your individual results with your employer. You can ask to see, correct or delete your information at any time.

1. About this policy

NeuraLearn Pty Ltd (ACN 683 371 591), which we call ‘NeuraLearn’, ‘we’ or ‘us’, respects your privacy. We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Because we handle health information, the Privacy Act applies to us regardless of our size. This policy explains what personal information we collect, why, how we use and protect it, and the choices you have.

2. The information we collect

We collect:

  • Personal details: your name, contact details, the company you work for (for corporate engagements), and booking and payment details.
  • Health information: your qEEG brain-mapping recording and the measures we take from it, the health-history answers in your intake, heart rate variability and cognitive measures where these are assessed, and brief session notes. Health information is sensitive information, and we collect it only with your consent and only what we need.

3. How we collect it

We usually collect your information directly from you: through your intake questionnaire, during your session, and in conversations with you. For corporate engagements, the company that engages us gives us scheduling information and who is attending, but not your health information. We also collect information when you contact us or sign up for something through our website.

4. Why we collect and use it

We use your information to:

  • Run your assessment and prepare your private report.
  • Deliver your sessions and re-scans, and keep your history for any future sessions.
  • Manage bookings, payments and our engagement with the company.
  • Improve our methods and develop our services.
  • Send you material you have asked for.
  • Meet our legal obligations.

5. Consent for health information

We ask for your consent before we collect your health information. This is set out in the participation and privacy consent you sign before your scan. You can withdraw your consent at any time by contacting us, though that may mean we can no longer provide the assessment.

6. Who sees your information, and who does not

Your information is seen by Dr Ardy and by the medical professionals who review every report before it is delivered. We do not give your individual results, report or intake answers to your employer. Your employer receives scheduling, the invoice and non-identifying team-level themes only.

We use trusted service providers to help us operate, for example secure cloud storage, our intake-form platform and email. They handle information on our behalf and are required to protect it. We never sell your information. You are free to share your own report with your employer, your doctor or anyone else; we do not share your identifiable results with anyone on your behalf.

7. De-identified data

We use de-identified data, meaning data that can no longer identify you, without restriction. This is how we refine our methods, develop new services, conduct research and report aggregate results. De-identified data contains nothing that points back to you.

8. How we store and protect your information

We store your information securely on our systems and take reasonable technical and organisational steps to protect it from misuse, loss and unauthorised access or disclosure. No system is perfectly secure, but we work to keep your information safe.

9. How long we keep it

We retain your information so your history is available for future sessions and to keep improving how we work. You can ask us to delete your information at any time, and we will do so unless the law requires us to keep certain records.

10. Accessing and correcting your information

You can ask us for a copy of the personal information we hold about you, or ask us to correct it, at any time. Contact our Privacy Officer (details below). We will respond within a reasonable time. If we cannot give you access or make a correction, we will explain why.

11. Where your information is stored

We store and access your information in Australia. We do not transfer your personal information overseas. If this ever changes, we will update this policy and handle any overseas disclosure in line with the Australian Privacy Principles.

12. Marketing

If you have asked to hear from us, for example by downloading a guide, we may send you helpful material. You can opt out at any time using the link in our emails or by contacting us. We do not use your health information for marketing.

13. Automated decisions

We do not use automated decision-making to produce your results. Every report is prepared by people and reviewed by medical professionals before it is delivered.

14. Our website

Our website may use cookies and basic analytics to help it work and to understand how it is used. You can control cookies through your browser settings.

15. Complaints

If you have a concern about how we have handled your information, contact our Privacy Officer first and we will work to resolve it. If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992.
